Traders see strong odds against a conviction on the attempted murder charge because the May 13 courthouse confrontation appears driven by a rapid escalation rather than premeditated intent, with reports indicating self-defense elements and mutual gunfire that left both Dalton Eatherly and the alleged victim wounded. The case remains in its early stages after the grand jury referral, with Eatherly still jailed on $1 million bond amid strict conditions and a gag order, while separate pending misdemeanor matters add procedural complexity. Historical patterns in Tennessee firearm cases and the absence of clear evidence of first-degree intent further support market skepticism that prosecutors will secure a conviction on the top charge rather than a lesser offense or acquittal. Key near-term catalysts include any grand jury decision and pretrial motions that could clarify self-defense viability.
